Terms & Conditions of Sale or Rental:

When a customer or purchasing party (hereinafter “You” or “Your”) purchases or rents any product from Garden Skate Project (hereinafter “GSP”) you acknowledge you have read and fully accept these Terms & Conditions. You are aware that by completing a purchase with GSP you are confirming an agreement to these Terms & Conditions and are voluntarily assuming all risk, liability and indemnifying Garden Skate Project LLC, its agents, representatives, other authorized users and all of GSP’s respective officers, directors, owners, employees, contractors, volunteers, sponsors, vendors, insurers, attorneys or any other person or business entity in any way associated with GSP (hereinafter “Indemnified Parties”). You agree to hold Indemnified Parties harmless from and against any liability, losses, damages, and cost related to attorney fees, legal fees, and settlement cost.

Disclaimer & Release of Liability:

By purchasing or rental of any GSP product you are acknowledging and are fully aware that skateboarding, scootering, in-line skating, bicycling, and/or any other related activities or action sports are hazardous and dangerous activities (hereinafter “Dangerous Activities”), which you are voluntarily participating in and are engaging in solely at your own risk. You acknowledge that engaging in these “Dangerous Activities” you are increasing your risk of experiencing serious injury, death, disability and/or loss (hereinafter “Losses”). By completing a purchase with GSP you agree to indemnify, hold harmless, and release Indemnified Parties of any liability related to “Losses” you or your next of kin, family, guardians, relatives, trustees, beneficiaries, administrators and/or heirs may experience.

Specific to the utilization of products purchased and/or rented by GSP, you are fully aware and agree as follows:

1.   In relation to your involvement in any activity, inclusive of “dangerous activities”, and concerning all liability for any damages you may experience or incur due to any reason whatsoever, you hereby consent:

a.   To release and waive all claims, demands, and causes of action for damages that you may hold against the company, its owners, shareholders, sponsors, vendors, or any other business associates.

b.   By purchasing or rental of any products and/or items from GSP, you expressly acknowledge and confirm that you, and as well as your authorized agents, have read, understood, and agreed to be bound by the rules of safety and conduct that govern use of our branded products. Please note that these rules are strictly enforced, and you agree to comply with them voluntarily.

c.   In the event of serious injury, disability or death, this disclaimer and release of liability is binding to your family members, next of kin, trustees, and any/all other entrusted assigns to your affairs.

Return/Refund Policy:

Due to every product being fully assembled prior to purchase and inspected by customer prior to purchase, Garden Skate Project (GSP) operates with an “All Sales Are Final” policy. All products are personally delivered by Garden Skate Project (GSP) or picked up by the customer, guaranteeing that customers will be 100% satisfied with GSP products prior to purchasing. Damaged Products:
Garden Skate Project does not assume any liability for damaged products after sales transaction is completed. If a product is damaged due to usage, modification of original product design, failure to maintain product or for any other reason after purchasing from GSP, customer assumes 100% of the liability of product.
